OFFICIAL COMPETITION RULES
HOW TO ENTER: No purchase is necessary to enter or win the Competition. The competition will run from www.teenagedirtbags2.com operated by UMO (the “Website”). The Competition will begin on 14 August 2014 and the deadline for receipt of entry is 30 September 2014 at 5pm (BST) (the “Competition Entry Period”). Any entry received after deadline will not be considered.
Participants are invited to take a photo which fits the theme of a ‘Teenage Dirtbag memory’ (the ‘Competition Entry’). To enter the Competition, Participants must be logged in to his/her Twitter and/or Instagram and/or Facebook account (individually and collectively the “Social Media Account/s”), upload their Competition Entry along with the hashtag TeenageDirtbags (i.e #TeenageDirtbags). By entering the Competition you become a participant (“Participant”). If the Participant’s Social Media Account is set to “protected mode”, his/her Competition Entry will not be visible in the Promoter’s Facebook/Twitter/Instagram feed; and, therefore, will not be received by the Promoter, resulting in the Participant’s failure to enter the Competition.
Participants must have a valid email address. The details provided by the Participant’s email account will be the identity of the Participant and, if selected for the prize, the identity of the Winner/s. The use of a bogus name or email address will disqualify a Participant. In the event of any dispute, all entries will be deemed made by the authorised account holder of the e-mail address registered to the Social Media Account used to submit the Competition Entry (submission of an e-mail address, for purposes of this paragraph, means direct submission of a participant’s e-mail address). The authorised account holder is deemed to be the person who is assigned an e-mail address by an internet access provider, online service provider or other organisation that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Participants may be requested to provide the Promoter with proof that they are the authorised account holder of the e-mail address associated with the Social Media Account they used to submit their Competition Entry. There is no limit to the number of entries per Participant but no Participant may submit the same Competition Entry more than once.
Any Competition Entry submitted must be the original work of the Participant; must not have been previously broadcast, recorded, published or transmitted and must not contain copyrighted works of any person or entity or otherwise infringe upon the copyrights, trademarks, privacy, publicity or other intellectual property rights of any person or entity. If the Competition Entry is the work of and/or features more than one person, all those involved must consent to it being entered into the Competition. By participating in this Competition, each Participant warrants that any Competition Entry entered, created or submitted by them does not infringe the rights of any person or entity and that such Participant has obtained all permissions, licences and rights required to lawfully participate in the Competition.
By entering the Competition, the Participant confirms that they agree to comply with these terms and conditions of the Competition, that they have obtained any third party permissions (if applicable) and that they have ensured that any such third party has agreed to comply with the terms and conditions of the Competition. The Promoter reserves the right, in its sole and unfettered discretion, to disqualify at any time during the Competition any Competition Entry that it believes may infringe the rights of any third party.
By submitting a Competition Entry, the Participant agrees to grant UMO a non-exclusive, fully paid and royalty free, sub-licensable and worldwide licence to use, edit, modify, display, publish, perform, reproduce, communicate, and distribute the Competition Entry on the Album artwork, and any associated marketing and advertising materials including without limitation the television advert. For the avoidance of doubt, all Participants agree to the free use of their names, photographs and general locations for publicity and news purposes during this and future promotions in any and all media by UMO or any associated or subsidiary company of the Universal Music Group of companies andUMO shall be entitled to display the Competition Entry on its websites and social media platforms. UMO shall not acquire any right, title or interest to the intellectual property rights in the Competition Entry, except as provided in this paragraph. If a person does not wish to grant UMO such rights in the Competition Entry then they should refrain from entering the Competition. By submitting the Competition Entry, the Participant warrants that they are free to grant such rights in the Competition Entry to UMO and agrees to indemnify UMO in respect of any claims, damages and costs arising as a result of the entrant’s breach of this warranty.
Each eligible Competition Entry will be featured in the ‘rock salute mosaic’ on the Website.
ELIGIBILITY: This Competition is open to any legal resident of the UK. All Participants and the person accompanying the winner must be at least 16 years of age to be valid and to be able to prove their age. Notwithstanding the foregoing, by submitting the Competition Entry, Participants under the age of 18 thereby warrant that they have obtained parental consent to enter the Competition and to assign the copyright in their Competition Entry to the Promoter. Participants under the age of eighteen (18) shall provide their parent’s/guardian’s email address so that, if necessary, the Promoter can confirm this with the Participant’s parents/guardian. If a Participant is under the age of 16, he or she should refrain from submitting a Competition Entry. Employees (and their immediate families or household members) of UMO and its respective parent companies, affiliates, subsidiaries and agents are not eligible to enter this Competition. UMO and its respective parent companies, affiliates, subsidiaries and agents are not responsible for any lost, late illegible, incomplete, postage due, misdirected or mutilated mail, any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable connections, or failed incomplete, garbled or delayed computer or mobile phone transmissions which may limit Participant’s ability to participate in the Competition.
SELECTION: After the Competition Entry Period closes, a panel of judges will review all of the eligible Competition Entries received and shall select one (1) winner (the “Winner”) that is deemed to be the most creative Competition Entry. The judges will also select 10 (ten) runners up winners (the “Runners Up”). The judges’ decision in selecting the Winner and Runners Up shall be final.
The Winner and Runners Up will be notified by private message (via the Social Media Account the Participant used to submit their Competition Entry) by a representative of UMO within five (5) days of the Competition Entry Period ending. Failure to respond within 24 hours will be considered Winner’s and/or Runners Up forfeiture of the Prize and an alternate winner may be selected from the pool of eligible entries.
PRIZE: The Winner will win two (2) tickets to 2015 Download Festival to be held at Donnington Park, Derby DE74 2RP from Thursday 11 June 2015 to Sunday 14 June 2015. Both tickets include five (5) night Camping Tickets and RIP Guest Area Passes (prize package valued at approximately £600).
The Runners Up will each win one (1) Teenage Dirtbag 2 CD (valued at approximately £10).
There is no cash or other alternative to the prizes stated. Prizes are not transferable and no part or parts of the prize may be substituted for other benefits, items or additions. The Winner and/or Runners Up assume all responsibility for taxes.
The Winner will be responsible for all incidental expenses including, but not limited to any travel costs, food or beverages purchased independent of prize package, tipping and phone calls. All expenses not specifically mentioned as being included in the prize package are excluded and are the responsibility of the Winner and the person/s accompanying the Winner. Travel insurance is not included in this prize and shall be the responsibility of the winner and the person accompanying the winner/s. Should the event be cancelled or dates are changed for any reason beyond the control of UMO or the event organisers, UMO reserves the right to substitute a different entertainment event without penalty or liability. Entries and prizes are non-transferable. No part or parts of the prize may be substituted for other benefits, items or additions.
The Winner also agrees to abide by the Download Festival rules and regulations specified at http://www.downloadfestival.co.uk/info.
GENERAL CONDITIONS AND RELEASES: A Participant or Winner may be disqualified from the Competition if he or she fails to comply with these Official Competition Rules, as determined in the sole discretion of UMO. Unless prohibited by law, entry constitutes permission to use winners’ names and likenesses in all media for publicity purposes without any further compensation. By entering or accepting a prize in the Competition, Participants and/or Winners agree to be bound by these Official Competition Rules and to conform to all laws and regulations.
By entering, participants and winners agree to release and hold harmless UMO, its parent, subsidiary and affiliated entities, directors, officers, employees, attorneys, agents and representatives from any damage, injury, death, loss, claim, action, demand or other liability that may arise from their acceptance and/or use of prize or their participation in this Competition, or from any misuse or malfunction of any prize awarded. UMO is not responsible for 1) failed, returned or misdirected notifications based on inaccurate information provided by the winner on entry 2) entries, and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer, mobile phone or technical error of any kind. UMO reserves the right, in its sole discretion, to cancel or suspend this Competition should a virus, ‘bug’ or other cause beyond UMO control corrupt the administration, security or proper play of the Competition. UMO reserves the right to modify the rules of the Competition in any way or at any time. These Official Competition Rules and this Competition shall be governed by English law and by entering the Competition all Participants agree that all disputes shall be submitted to the exclusive jurisdiction of the High Courts of Justice.
